Conflict between Farman-i-shahi and this
Ordinance.
22. The provision of the Farman-i-shahi No. 6 dated Motibagh Palace. Patiala, the 11th of March, 1947, in so far as they are repugnant to the provision of this Ordinance shall, to the extent of the repugnancy, be void.
Building on the holding constructed by
landlord.
23. Where there are any buildings on any holding constructed by the landlord or at his expense :—
(a) the value of such buildings shall also be assessed by the Partition Officer with reference to the notified date and shall form a part of the total compensation payable to the landlord, or
(b) where the occupancy tenant elects not to pay the compensation the Partition Officer may, while partitioning land, give due consideration to the claim of the landlord to such building.
Sham-I-Lat.
24. Where under the provisions of this Ordinance the holding or any part thereof is transferred absolutely to the occupancy tenant the rights of the landlord in the sham-Mat shall as from the notified date devolve on the occupancy tenant to the extent of the transfer without payment of any compensation in respect thereof.
Supplementary
powers of Financial Commissioner and Partition Officer.
25. The Financial Commissioner and the Partition Officer shall have all the powers of a civil court under the Code of Civil Procedure, 1908, in force in the Union, for the purpose of administering oaths, taking evidence on oath, and of enforcing the attendance of witnesses and compelling the production of documents and material objects and the Financial Commissioner and the Partition Officer shall be deemed to be civil courts for the purposes of section 195 and of Chapter XXXV of the Code of Criminal procedure in force in the Union.
Jurisdiction of civil courts barred.
26. No civil court or any other authority shall have jurisdiction to settle, decide or deal with any question which is, by or under this Ordinance, required to be settled, decided or dealt with by the Committee or the Financial Commissioner or the Partition Officer.
Bar of
certain suits and proceedings.
27. (1) No suit or other proceeding shall lie against, the Government for any act done or purporting to be done under this Ordinance or any rule made thereunder.
(2) No Officer or servant of the Government shall be liable in respect of any such act in any civil or criminal proceeding, if the act was done in good faith in the course of the execution of the duties, or the discharge of the functions imposed by or under this Ordinance.
Execution from registration, and payment of
stamp.
28. No instrument or document executed or made in pursuance of the provisions of this Ordinance or the transfer of any holding under this Ordinance shall he liable to registration or payment of stamp thereon, notwithstanding any law in force in the Union,
Power to make rules.
29. (1) The Government may make rules to carry out the purposes of this Ordinance.
(2) In particular and without prejudice to the generality of the foregoing provision. such rules may provide for:—
(a) all matters expressly required or allowed by this Ordinance to be prescribed;
(b) the procedure to be followed by the Financial Commissioner and the Partition Officer in the discharge of their duties and functions;
(c) the manner in which the compensation is to be deposited by the occupancy tenant in the tehsil treasury :
(d) the manner in which the compensation is to be paid to the landlord;
(e) fees. if any. to be paid on applications or petitions under this Ordinance:
(f) transfer of proceedings from one Asstt. Partition Officer to another;
(g) method of publishing notices.

SCHEME OF ALLOCATION OF AREAS
For the purpose of allocating claims of displaced persons, evacuee land in East Punjab and Pepsu was taken to form a pool. The weight attached to factors such as having a temporary allotment or being a colonist of a particular district hag been explained in Chapter TV— Principles of Allocation. The scheme of allocation of areas given in Appendix II-A was, as has been explained, a superimposition on schemes of allocation adopted during the period of temporary settlement. Certain areas were taken together, for instance, Ambala and Ludhiana districts for the settlement of displaced persons from the Rawalpindi Division, Ferozepur and Bhatinda districts and the Sirsa tahsil of Hissar district for the settlement of displaced persons from Lahore and Montgomery districts. Gurgaon district with Narnaul tahsil of Mohindergarh district of PEPSU for the settlement of displaced persons from Dera Ghazi Khan district, Gurgaon district with Bawal tahsil of Mohindergarh district in respect of displaced persons from Mianwali district, and Ambala district with the former Kalsia tahsil of PEPSU for the settlement of displaced persons from Rawalpindi district. In the scheme of allocation the whole of PEPSU was taken to be a single area of allocation within which further schemes of sub-allocation explained in Appendix VIII provided for the distribution of claims between different districts and parts of districts.
Appendix II-A sets out the scheme of allocation of areas in accordance with which the work of allocating claims was initiated in July, 1949. Due to consolidation of claims of individuals to land held in different villages and other factors, as the work of resettling claims proceeded, divergencies necessarily appeared and from time to time allocation adjustments had to be made. These are reflected in Appendix II-B
The figures given in the Allocation Statements and the Resettlement Statements are in net standard acres. That is, in respect of each district of West Punjab the net area due after application of the cut is stated as the net allocation demand. The scheme of graded cuts was applied to the actual distribution between different grades of the holdings of displaced persons from particular districts and their net demand was thus worked out- The demand on account of any district in West Punjab included the demand on account of its colonists who held land in another district of West Punjab or outside West Punjab in Western Pakistan. In the Allocation Statement, the figures in column 2 (Area abandoned) are in net standard acres and include the demand on account of displaced persons from a district in West Punjab as well as the colonists of that district. A special effort to consolidate claims to land held in different districts was made during June, 1949, as a result of which the figures given for different districts in column 2 of the Allocation Statement increased to the Figures given in column 3 (Net Allocation Demand). This demand was then spread over, as explained in column 4, between various districts in East Punjab and in PEPSU.
The Resettlement Statement given in Appendix II-A presents the scheme of allocation from the point of view of districts of East Punjab and PEPSU'. The area required for the colonists of East Punjab districts and of PEPSU is stated in column 3, only the balance of the area available in the district being allocated to displaced persons other than the colonists of that district.
